The Three-Ballot Pattern

California voters were asked three times in six years to expand rent control. The California Apartment Association and allied real estate investors defeated all three. Gavin Newsom opposed or stayed silent on all three while accepting donations from the real estate interests that funded the opposition campaigns. This is one of the clearest follow-the-money sequences in his record.


Background: Costa-Hawkins and the Rent Control Ceiling

The Costa-Hawkins Rental Housing Act (1995) is the structural barrier. It prohibits rent control on single-family homes, condominiums, and any residential unit built after February 1, 1995. It also mandates vacancy decontrol — landlords can reset rent to market rate when a tenant leaves. Costa-Hawkins has effectively frozen California’s rent control geography at the 1995 line while the rental market expanded by millions of units above that threshold. Props 10, 21, and 33 were all attempts to repeal or modify Costa-Hawkins.


Proposition 10 (2018) — The First Attempt

Prop 10 would have repealed Costa-Hawkins entirely, allowing local governments to expand rent control to any residential property. Newsom opposed it.

Money

The no campaign raised approximately $72 million — funded primarily by the California Apartment Association, Blackstone Group, Essex Property Trust, AvalonBay Communities, and other large institutional landlords. The yes campaign raised approximately $25 million. Prop 10 failed 61–39%.

Newsom’s position: Opposed. He argued it would reduce housing production by disincentivizing developers. This is the standard real estate industry argument. Its empirical basis is contested — the evidence that rent control reduces supply is mixed, and the evidence that rent control keeps existing tenants housed is strong. Newsom adopted the developer-class framing on this question.

He won the 2018 gubernatorial election with major California Apartment Association-linked donor support. He opposed the ballot measure that would have directly reduced landlord income. These facts are temporally adjacent.


Proposition 21 (2020) — The Modified Second Attempt

After Prop 10’s landslide defeat, tenant advocates brought a narrower measure. Prop 21 would have allowed rent control on units more than 15 years old while exempting small landlords who own single-family homes and own two or fewer properties. This was a significant concession to the real estate industry — newer units, condos, and small landlords were explicitly protected.

Newsom did not endorse Prop 21. He said he supported the “spirit” of renter protections while declining to campaign for it. In California ballot measure politics, a Democratic governor not endorsing is functionally a signal against — it tells Democratic-leaning voters the measure is not a party priority.

The no campaign again raised approximately $80+ million from institutional landlords and real estate investment trusts. Prop 21 failed 60–40%.


Proposition 33 (2024) — The Widest Defeat

Prop 33, the Justice for Renters Act, returned to the Costa-Hawkins repeal framework. By 2024, California’s rent crisis had deepened significantly — median rents in coastal metros were among the highest in the nation, homelessness had increased, and over a million California households were spending more than 50% of income on rent.

Newsom actively opposed Prop 33. He called it “deeply flawed” and argued it would worsen housing production.

Money

The no campaign raised over $100 million — the most expensive opposition to a rent control measure in American history. Funding sources: Blackstone, Equity Residential, Essex Property Trust, the California Apartment Association, and other institutional investors. This is capital openly purchasing a ballot outcome.

Prop 33 failed 62–38% — a wider margin than either of its predecessors despite worsening housing conditions. The opposition’s financial advantage was decisive.

Newsom’s active opposition is the sharpest point in his record on this issue. In 2024, with California’s rent crisis at its most acute and 62% of California renters paying over 30% of income on housing, the governor’s explicit position was that expanding tenants’ legal protection from rent increases was “deeply flawed.”


The Donor Connection

The California Apartment Association is a documented contributor to Newsom’s campaigns and to California Democratic political operations. This is not a secret. It is the stated mechanism of California housing politics: landlord and real estate investor money flows to Democratic politicians; Democratic politicians oppose rent control using the developer-class framing; tenant advocates bring ballot measures; the same money defeats the ballot measures; repeat.

The working-class tenants who need rent stabilization — who have no ability to compete with $100 million no campaigns — are the people who lose in each cycle.


Contradiction

Fighting for Renters While Opposing Rent Stabilization: Newsom campaigns as a pro-tenant housing reformer — expanding Medi-Cal, funding homelessness programs, championing zoning reform. Yet he actively opposed all three statewide rent control measures (Props 10, 21, 33), the most direct tools government has to keep working-class renters housed. He frames himself as a housing advocate while taking donations from the landlord class opposing rent stabilization. The contradiction: genuine housing reform requires either more supply (which eight years of zoning reform has not produced) or limiting landlord income (which Newsom explicitly opposes). His compromise — supply-side promises — has failed working-class renters while protecting donor interests.

The Supply Argument and Its Limits

Newsom’s argument against rent control is consistent: it reduces housing supply by disincentivizing construction. This argument has two problems.

First, Props 10, 21, and 33 all explicitly exempted new construction from rent control application. The supply argument was not factually applicable to the specific measures on the ballot. A governor can oppose a measure on supply grounds; he should at least acknowledge that these measures were not targeting new construction.

Second, California’s “supply-side” housing approach — the alternative Newsom offers — has not produced the supply increases its proponents predicted. What Tenants Needed

Approximately 45% of California households are renters. In major coastal metros — Los Angeles, San Francisco, San Jose, Oakland — renter households are the majority. The majority of California renters spend more than 30% of income on rent. A significant share spend more than 50%. These are the working class and working poor of California — the people who staff every hotel, hospital, school, and restaurant in the state.

Rent stabilization — limiting annual rent increases to something closer to wage growth rather than market rate — is one of the most direct tools a government can deploy to keep the working class housed in the communities where they work. Newsom blocked it three times. His donors funded the campaigns that blocked it alongside him.

Analytical Patterns

The Genuine Win + Structural Limit

Newsom can claim he expanded Medi-Cal and other housing programs, which are real. The genuine win: policy action that helps some people. The structural limit: none of these programs address rent stabilization, the single most direct lever government has to keep working-class renters housed. Newsom opposed the tools (Prop 10, 21, 33) that would have directly limited landlord income. He offered alternatives (zoning reform, development incentives) that benefit developers and landlords while pretending to solve the housing crisis. Real housing relief would require confronting landlord-class interests; Newsom chose not to.

The Villain Framing

The villain in Newsom’s rent control opposition is “NIMBYs” and “supply-side skeptics” — people who oppose zoning reform. The actual structural villain — the landlord and real estate investor class with $100+ million to spend defeating rent control ballot measures — is never framed as an opponent. Instead, Newsom frames supply-side housing as the enlightened position and rent control as outdated. This reframes the question: instead of “why does Newsom accept money from landlords who oppose rent control?” the question becomes “shouldn’t we all want more housing supply?” It’s a reframe that protects the donor class from naming.

The Two-Audience Problem

Newsom can campaign as a housing reformer (genuine belief: he does support some housing production) while serving landlord-class interests (opposing rent control). To tenant advocates, he says “we need more supply.” To landlords, he says “I will not support rent control.” Both constituencies hear that he’s protecting their interests because he’s managing to advance both messages without directly contradicting either.

The Pilot Program / Delay Mechanism

The supply-side strategy itself is a delay mechanism. Instead of rent control (immediate relief), Newsom proposes zoning reform, streamlined approvals, and developer incentives — all things that take years to produce housing (if they produce housing at all). Eight years of supply-side legislation has not bent California’s cost curve. Meanwhile, renters wait. The “wait for supply” argument is the longest pilot program in California housing politics.
