Koch Donor Summit Attendance

Thomas attended exclusive Koch donor summits at least twice, most recently at the 2018 Palm Springs gathering. His role was not passive. He spoke at high level donor dinners specifically designed to encourage continued giving from Koch network members. The attendees were what Koch organizers called “titans of industry” from health insurance, oil, Wall Street, and real estate. Each contributed $100,000 or more annually to Koch political operations.

For the public, if it were ever disclosed, the framing would be “a justice attending a conservative gathering.” The reality is a sitting member of the highest court in the country being deployed as a fundraising prop for a political operation that spends hundreds of millions to influence the cases he decides. The two audiences receive two different stories about the same event.


Leonard Leo as Conduit

Leo’s role in the Thomas relationship spans the justice’s entire career on the bench.

Confirmation infrastructure. Leo delayed his start at the Federalist Society in 1991 to assist with Thomas’s Senate confirmation hearings. The investment preceded the return by decades.

Personal integration. Thomas is godfather to one of Leo’s children. A painting at Crow’s Camp Topridge resort depicts Leo, Thomas, Crow, and others together. The donor network literally hanging on the wall.

Financial pipeline. Leo directed $80,000+ in payments to Ginni Thomas’s consulting firm Liberty Consulting through Kellyanne Conway’s Polling Company in 2011 and 2012. Leo’s email instruction regarding the arrangement. “No mention of Ginni, of course.” An additional $25,000 was directed through the same channel. The payments were billed to the Judicial Education Project, one of Leo’s dark money organizations later renamed the 85 Fund.

Social engineering. Leo hosted Thomas at New England getaways and arranged trips to Crow properties. Leo connected Thomas to Koch donor events and managed the interface between the justice and the broader donor class.

The $1.6 billion war chest. In 2021 Chicago businessman Barre Seid donated 100 percent of his shares in Tripp Lite to Leo’s Marble Freedom Trust. The shares were sold to Eaton Corporation for $1.6 billion. The largest known donation to a political advocacy group in American history. The structure allowed Seid to avoid approximately $400 million in capital gains taxes. Marble Freedom Trust then distributed $153 million to the Rule of Law Trust and $41.1 million to Donors Trust. Leo now controls more money than most political parties.

Money

Leo helped select Thomas for the Court. Assisted his confirmation. Became his personal friend and family member. Directed concealed payments to his wife. Arranged his integration into the Koch donor network. Connected him to Crow’s patronage system. And now controls $1.6 billion in dark money to fund the broader movement Thomas’s rulings serve. One man links the justice to every major funding stream in the conservative movement. This is not friendship. This is infrastructure.

Thomas’s attendance at Koch donor events was not reported on his annual financial disclosures. The private jet travel to Palm Springs in 2018 was omitted from his ethics filings. This mirrors the broader pattern. Every component of the Koch Leo Crow triangle operated in undisclosed space until investigative journalism forced partial revelation in 2023.

The voluntary ethics code adopted by the Supreme Court in November 2023 contains no enforcement mechanism. It was designed as a response to public pressure, not as a constraint on behavior. The code exists. The enforcement does not.
