Who They Are

PhRMA (Pharmaceutical Research and Manufacturers of America) is the principal trade association and lobbying organization for brand-name pharmaceutical manufacturers in the United States. Founded in 1958 as the Pharmaceutical Manufacturers Association and renamed in 1994, PhRMA is incorporated as a 501(c)(6) trade association—a membership organization, not a company. It aggregates industry political power and deploys it through direct lobbying, PAC donations, dark money channels, and astroturf campaigns.

Scale and Presence: As of June 2025, PhRMA has 31 pharmaceutical company members (down from 68 previously), including Bayer, Biogen, Johnson & Johnson, Eli Lilly, Gilead Sciences, Novo Nordisk, Novartis, Pfizer, Bristol-Myers Squibb, Merck, Boehringer Ingelheim, Sanofi, Regeneron, and others. Member companies reported combined domestic sales of $371.6 billion in 2024 (up 17% in a single year), with international revenues pushing total member sales to $500.4 billion. PhRMA member companies collectively control roughly half the global pharmaceutical market.

Membership Losses: Between 2022 and 2023, three major companies exited PhRMA—AbbVie (December 2022), AstraZeneca (2022), and Teva (2023)—following passage of the Inflation Reduction Act. These departures cost PhRMA approximately $100 million annually in membership dues. In 2017, PhRMA expelled 22 companies under stricter R&D spending requirements (requiring a three-year average global R&D-to-sales ratio of 10%+ and at least $200M per year in R&D spending).

Revenue and Scale: PhRMA’s annual member dues peaked at $600 million in 2021 but declined to $483 million by 2023 following member departures. Leadership: Stephen Ubl has served as PhRMA’s president and CEO since September 2015. Ubl’s career represents the revolving door: he began as a Capitol Hill staffer for Senator Charles Grassley (R-Iowa, a key Medicare voice), became VP of Legislation at the Federation of American Hospitals, spent 10 years as president and CEO of AdvaMed (the medical device industry trade association), and has now led PhRMA’s political operations for over a decade. His entire career has been in healthcare lobbying and trade association leadership—no pharmaceutical research or patient care background.

Lobbying Infrastructure: PhRMA employed 195 registered federal lobbyists in 2021, of whom 140 (71.79%) were former federal employees—individuals with direct knowledge of how Congress and regulatory agencies work. Top-tier retained law and lobbying firms include Covington & Burling ($1.4 million annually), Akin Gump ($550,000), Capitol Counsel ($380,000), and BGR Group ($260,000). Former congressman Charles Boustany (R-LA) and former congressman Ron Klink (D-PA) appear on the PhRMA lobbyist roster. Additionally, nearly 340 former congressional staffers now work for pharmaceutical companies or their lobbying firms.


What They Want

PhRMA’s singular political objective is preventing Medicare from negotiating drug prices. The organization estimates that full Medicare negotiation authority would cost its members $100 billion or more over the next decade (2026–2035). This is existential: if Medicare can negotiate prices, state Medicaid programs will demand the same authority. Private insurers will follow. The entire U.S. drug pricing structure—which extracts nearly three times the international price for equivalent drugs—collapses.

Secondary political objectives include:

Blocking state-level price negotiations (California, New York, and other states have proposed state drug price boards; PhRMA has funded campaigns to defeat every one). Defeating drug importation from Canada and other countries (U.S. brand-name drug prices are 422% of OECD comparator prices; Canadian prices are 44% of U.S. prices). Eliminating patent transparency requirements and proposals that would disclose the gap between R&D costs and drug prices. Protecting the “evergreening” practice—filing dozens of secondary patents to extend monopoly periods indefinitely. Maintaining regulatory deference to the pharmaceutical industry, resisting FDA approval acceleration for generic drugs, and ensuring that Medicare lacks the structural leverage (formulary authority, price ceilings) to achieve meaningful savings even if negotiation authority were granted.


Who They Fund

Direct PAC Donations: PhRMA operates the Pharmaceutical Research & Manufacturers of America Better Government Committee (FEC ID: C00021972), which reported 2024 receipts of $11.2 million and disbursements of $10.8 million. Direct PAC contributions to individual members of Congress range from $5,000 to $50,000 per cycle. However, these official PAC figures dramatically understate PhRMA’s actual political influence, as the organization routes most of its political spending through dark money channels.

Member Company PACs: Individual pharmaceutical company PACs layer additional spending on top of the PhRMA PAC. In 2024, Pfizer’s PAC contributed $4.2 million, Johnson & Johnson’s PAC contributed $3.8 million, Merck’s PAC contributed $3.1 million, AbbVie’s PAC contributed $2.9 million, and Eli Lilly’s PAC contributed $2.7 million. These five companies alone account for roughly $18 million in PAC spending per cycle.

Individual Executive Donations: Pharmaceutical executives donate directly to candidates, PACs, and Super PACs outside the formal PAC structure. In 2024, Pfizer executives alone contributed over $18 million, J&J executives contributed $14 million, Merck executives contributed $10 million, and Eli Lilly executives contributed $9 million. These are not disclosed as PhRMA contributions but represent the same donor class deploying capital for the same policy objectives.

Party Split: Pharmaceutical and health product industry contributions have historically favored Republicans. From 1999 to 2018, the industry split contributions 58.9% Republican, 41.1% Democratic. In 2024, the split was 59% Republican, 41% Democratic. However, this overstates bipartisanship: the industry donates strategically to key committee members of both parties, particularly those who have demonstrated loyalty on price negotiation votes.

Strategic Committee Targeting: PhRMA concentrates contributions on members of committees with direct jurisdiction over drug pricing. JAMA Internal Medicine analyzed 1999–2018 contribution data and found that 13 of the top 20 Senate pharma recipients served on the Finance Committee, 17 of the top 20 House recipients served on Energy & Commerce or Ways & Means, and 39 of the top 40 recipients overall belonged to health jurisdiction committees. As of 2023–2024, key recipients include:

Dark Money Infrastructure: PhRMA’s most significant political spending does not flow through its official PAC but through dark money nonprofits. From 2010 through 2025, PhRMA contributed more than $34.5 million to the American Action Network (AAN), a Republican-aligned dark money group linked to House GOP leadership. Specific years include: 2010 ($3.0M), 2020 ($6.5M), 2022 ($7.5M, a record), 2023 ($4.0M), 2024 ($4.0M), and 2025 ($4.0M, which funded the “One Big Beautiful Bill Act”—CBO estimated this produced an $8 billion windfall for drugmakers). State-Level Ballot Measure Targeting: From 1999 to 2018, the pharmaceutical industry contributed $877 million to state-level candidates and ballot measures—more than twice its federal spending. Much of this targeted ballot measures on drug pricing. In California, the industry spent $399 million, including massive campaigns in 2005 and 2016 to defeat drug pricing ballot measures. In Ohio in 2017, the industry spent $61 million to defeat a ballot measure requiring the state to pay no more for drugs than the VA negotiated price. In every state where a ballot measure threatened drug pricing, the industry flooded the state with opposition spending and won every time, until recently.


What They’ve Gotten

Medicare Part D (2003): The Original Sin

The Medicare Prescription Drug, Improvement, and Modernization Act (MMA) of 2003 created Medicare Part D, providing drug coverage to seniors—but embedded a “non-interference clause” explicitly forbidding the Secretary of Health and Human Services from negotiating drug prices or requiring any formulary structure. This provision was inserted at pharmaceutical lobbyists’ urging and was entirely unique to drugs. Medicare negotiates prices for every other service and product it purchases—hospital care, medical devices, physician services—but was legally prohibited from doing so for prescription drugs. The Congressional Research Service estimated in 2007 that even if the non-interference clause were stripped, the pharmaceutical industry had engineered structural barriers (lack of formulary authority, no price ceiling mechanisms) that would prevent meaningful savings. The result: more than 20 years of unfettered monopoly pricing.

The drug industry made more than $50 million in campaign contributions from 1999 to 2003 to keep drug prices unregulated. Congressman Billy Tauzin (D→R, Louisiana), who chaired the House Energy and Commerce Committee, shepherded the MMA through Congress with the non-interference clause intact. He then announced in December 2004 that he was leaving Congress to become PhRMA’s president and CEO at a salary of $2 million per year—a 12x increase from his congressional salary of $162,100. He began work at PhRMA on January 4, 2005, immediately after his congressional term ended on January 3.

HR 3 (2019): The House Victory That Stalled in the Senate

The Elijah E. Cummings Lower Drug Costs Now Act passed the House on December 12, 2019, by a vote of 230–192 (essentially party-line). It was the most aggressive drug pricing legislation in modern history, authorizing HHS to negotiate prices for 25–50 single-source, brand-name drugs, with prices set between the lowest price in any of six high-income reference countries and 120% of their average. The Congressional Budget Office estimated the bill would save Medicare $500 billion over 10 years—meaning $500 billion in revenue that PhRMA members would not receive.

PhRMA spent $29.3 million on federal lobbying in 2019 alone and launched a seven-figure advertising campaign against HR 3 in September 2021 (when it was reintroduced in Build Back Better). The organization successfully lobbied enough House Democrats—led by Representatives Scott Peters (D-CA) and Jake Auchincloss (D-MA)—to weaken the bill’s provisions. In the Senate, PhRMA’s efforts proved more successful: Majority Leader Mitch McConnell refused to bring the bill to a vote, and the pharmaceutical industry’s work with moderate Democrats prevented any drug pricing legislation from advancing through reconciliation in 2021. HR 3 died without ever reaching the Senate floor.

The Inflation Reduction Act (2022): PhRMA’s Biggest Loss—and How It Was Weakened

The Inflation Reduction Act passed on August 16, 2022, by a 51–50 Senate vote (with Vice President Harris casting the tie-breaking vote) and 220–207 in the House. It was PhRMA’s biggest policy defeat in modern history. Despite spending $29.2 million on federal lobbying in 2022 alone—the most of any single organization that year—PhRMA could not prevent the bill’s passage. It remains the first major breach in the industry’s structural control of drug pricing policy.

However, the IRA’s drug pricing provisions were significantly weakened compared to original proposals and HR 3:

Scope dramatically narrowed: The original HR 3 proposed negotiating 50+ drugs immediately. The IRA starts with only 10 Part D drugs negotiable in 2026, expanding to 15 in 2027, 15 more in 2028 (Part B and D combined), and 20 per year from 2029 onward. Medicare covers roughly 12,000 drugs. The IRA’s negotiation window affects approximately 0.1% of the market initially—or 99.8% remains protected.

Patent eligibility extended: Small-molecule drugs become eligible for negotiation only after 9 years on the market; biologics after 13 years. Given average patent exclusivity periods of 12 and 16 years respectively, the IRA’s negotiation window does not affect more than half a drug’s patent life. PhRMA continues active lobbying to extend the small-molecule window to match biologics (a change that would push negotiation to year 13+, effectively eliminating the negotiation provision’s real-world impact).

Private insurance exclusion: The original HR 3 would have extended negotiated prices to private insurance. The Senate parliamentarian ruled this violated reconciliation rules, so the provision was removed. Medicare negotiation applies only to Medicare, not to 200+ million privately insured Americans.

No formulary authority: Even after negotiation, Medicare cannot establish a national formulary or refuse to cover selected drugs, eliminating the core leverage tool used by the VA and Medicaid to achieve price reductions.

Ceiling price formula: Manufacturers cannot be required to go below 25–40% off current prices (60% off for drugs on market 16+ years). International comparisons show other wealthy nations achieve 60–70% reductions through direct negotiation.

PhRMA's "Loss" as Strategic Victory: PhRMA publicly framed the IRA as a devastating defeat. The reality is more nuanced. The organization preserved the system while conceding a symbolic provision. The estimated $160 billion "saved" over 10 years is less than 3% of federal drug spending over the same period. Pharma revenue remains essentially unaffected. This is the defining example of donor capture: the industry maintains structural control while politicians claim victory.

Legal Counterattack: In June 2023, PhRMA sued HHS and CMS in the Western District of Texas, arguing the negotiation program violates the Fifth Amendment (due process), the Eighth Amendment (excessive fines), and the non-delegation doctrine. The case was initially dismissed in February 2024, but the Fifth Circuit reversed the dismissal in September 2024, allowing litigation to proceed. As of mid-2025, pharmaceutical companies had lost over 12 court challenges to the IRA’s pricing provisions, but the Fifth Circuit ruling keeps the core challenge alive.

Patent Thicket and Evergreening: Extending Monopoly for Decades

Pharmaceutical companies routinely file dozens to hundreds of secondary patents on a single drug after its initial FDA approval, covering trivial modifications such as new delivery devices, new salt forms, different dosing regimens, crystalline structures, and method-of-use variations. This creates a “patent thicket” that forces generic and biosimilar manufacturers to either invalidate all patents (enormously expensive and time-consuming) or wait, effectively extending monopoly pricing for years or decades beyond the original patent’s expiration.

Humira Case Study (AbbVie): The original adalimumab patent expired in 2016. AbbVie filed over 300 patent applications related to Humira; approximately 160 issued. Over 90% of those patent applications were filed after FDA approval in 2002. Every major biosimilar competitor settled rather than litigate the entire thicket. Biosimilar competition did not enter the U.S. market until 2023—seven years after the primary patent expired. AbbVie secured an estimated $100+ billion in additional U.S. revenue through this delay. The Innovation Medicine Access (I-MAK) organization estimates that delayed generic entry for Humira, Eliquis, and Enbrel alone cost U.S. payers $167 billion beyond what would have been paid under primary-patent-expiry competition.

A UCLA Anderson analysis of 355 branded drugs found that secondary patents extended monopoly protection by an average of three years per drug, generating excess consumer costs of $52.6 billion (and researchers described these figures as conservative).

Legislative Kill: In 2019, Senator John Cornyn (R-TX) introduced the Affordable Prescriptions for Patients Act, which would have given the FTC authority to crack down on patent thickets, including the power to require disgorgement of ill-gotten profits and prosecute product hopping. PhRMA mobilized its lobbyist army against the bill. As STAT News reported, there were “multiple calls among PhRMA trade association members on the issue,” and PhRMA’s lobbyists privately pushed for the patent provisions to be “struck altogether.” Senator Thom Tillis (R-NC), responding to industry lobbying, raised concerns, and Cornyn publicly pledged to strip the provision. A bipartisan version passed the Senate unanimously in July 2024 but was never enacted into law.

IRA Drugs and Evergreening: Public Citizen analyzed the first 10 drugs selected for Medicare price negotiation and found that 9 out of 10 showed evidence of manufacturers engaging in anticompetitive patent practices or evergreening. Patent protection on many of these drugs could extend well into the 2030s or 2040s.

Pay-for-Delay (Reverse Payment Settlements)

A separate but related anticompetitive practice involves brand-name companies paying generic manufacturers not to bring competing drugs to market after the brand-name company sues over alleged patent infringement. These “reverse payment” or “pay-for-delay” settlements cost U.S. patients an estimated $12 billion per year in artificially elevated prices, with approximately $3 billion coming directly from patients’ pockets through higher copays and coinsurance. The Drug Competition Enhancement Act, which would prohibit product hopping and strengthen FTC authority to challenge these settlements, has been repeatedly introduced in Congress and repeatedly stalled—in part due to PhRMA lobbying.

Drug Importation from Canada: Two Decades of Opposition

Congress passed the legal framework permitting wholesale importation from Canada in 2003 but required approval from the HHS Secretary, which the pharmaceutical industry successfully prevented for 20 years.

In 2017, PhRMA created and funded the “Partnership for Safe Medicines,” a nominally grassroots nonprofit, to orchestrate an advertising campaign against importation legislation. PhRMA Senior Vice President Scott LaGanga had led the partnership for 10 years before moving to a senior PhRMA role. The partnership ran “dangerous drug importation” ads and orchestrated a letter signed by 160 groups opposing importation—most of them industry-linked trade organizations.

U.S. prescription medicines cost three times what they cost in Canada. In November 2020, when the Trump administration issued a final rule allowing states to establish importation programs, PhRMA immediately sued in federal court to block it, alongside the Partnership for Safe Medicines and the Council for Affordable Health Coverage.

In January 2024, the FDA approved the first-ever state importation program—Florida—overriding decades of industry objections. PhRMA called the decision “reckless” and stated it was “considering all options” to prevent implementation. As of early 2026, seven states had passed importation legislation.

The 2009 White House-PhRMA Deal: Shaping the Affordable Care Act

During the 2009–2010 ACA debate, PhRMA under Billy Tauzin negotiated a secret deal with the White House and Senate Finance Committee Chairman Max Baucus: PhRMA agreed to $80 billion in cost-cutting over 10 years, and in exchange, the White House committed to preserve the Medicare non-interference clause (no drug price negotiation) and to block drug importation provisions from the bill.

Tauzin stated publicly: “The White House blessed it.” Senior White House official Jim Messina confirmed: “The president encouraged this approach.” When House Energy and Commerce Chair Henry Waxman attempted to add back drug reimportation, Medicare negotiating power, and faster generic access—provisions worth hundreds of billions—PhRMA pressured Tauzin to go public with the deal to enforce the White House’s commitment. Progressive Democrats were furious. Representative Raul Grijalva responded: “Are industry groups going to be the ones at the table who get the first big piece of the pie and we just fight over the crust?”

PhRMA then spent up to $150 million in advertising in support of the Baucus bill—a bill specifically shaped to protect the industry’s core interests.

Revolving Door: The Billy Tauzin Case and Broader Pattern

Billy Tauzin (D→R, Louisiana) served in Congress from 1980 to 2005. He switched from Democrat to Republican after the 1994 Republican Revolution and rose to become Chairman of the House Energy and Commerce Committee—the key committee with jurisdiction over Medicare, the FDA, and pharmaceutical regulation.

The Quid Pro Quo: In 2003, Tauzin was the architect of Medicare Part D—specifically the version that included the non-interference clause prohibiting Medicare from negotiating drug prices. The CBO later estimated this clause would cost Medicare beneficiaries and taxpayers hundreds of billions in excess drug costs over the program’s lifetime. While Tauzin was still in Congress shepherding the bill through, he was simultaneously negotiating his exit to become PhRMA’s president and CEO.

The Salary: Congressional salary in 2004 was $162,100. PhRMA’s salary to Tauzin beginning in 2005 was $2 million per year—a 12x increase, believed at the time to be the highest salary ever paid to an ex-congressman turned Washington lobbyist. In 2010, his final year at PhRMA, Tauzin earned $11.6 million, making him the highest-paid health-law lobbyist in the country. His total lifetime receipts from the drug industry: $218,000 in campaign contributions while in Congress plus approximately $10 million minimum in PhRMA salary over five years.

Barack Obama cited Tauzin as the embodiment of Washington corruption during his 2008 campaign: “And you know what, the chairman of the committee, who pushed the law through, went to work for the pharmaceutical industry making $2 million a year. Imagine that.”

Stephen Ubl (Current CEO): Ubl has served as PhRMA president and CEO since September 2015. His career represents the revolving door: Capitol Hill staffer for Senator Charles Grassley (R-Iowa), VP of Legislation at the Federation of American Hospitals, EVP of Federal Government Relations at AdvaMed (medical device trade association, 1998–2004), healthcare consultant (2004–2005), president and CEO of AdvaMed (2005–2015, lobbying on medical device regulation and delaying the ACA’s medical device excise tax), then PhRMA CEO (2015–present). Broader Revolving Door: The scale is systematic. Nearly 340 former congressional staffers now work for pharmaceutical companies or their lobbying firms. As of 2024, 145 out of 206 PhRMA lobbyists (70%) were former federal employees. FDA transitions are particularly revealing: Since 2000, every FDA commissioner has gone on to work for industry. Internal FDA emails obtained via FOIA show FDA ethics staff proactively telling departing officials how to continue influencing the agency “behind the scenes” from industry jobs.

Recent specific examples include Patrizia Cavazzoni, who directed FDA’s Center for Drug Evaluation and Research (the division that approves drugs) and then became Pfizer’s Chief Medical Officer; Doran Fink and Jaya Goswami, who evaluated Moderna’s COVID vaccine for FDA and were hired by Moderna within months; and former FDA Commissioner Scott Gottlieb, who joined Pfizer’s board.

The Incentive Structure: The revolving door creates a systematic conflict of interest. An FDA reviewer evaluating a Pfizer drug application knows that refusing approval damages their post-government employment prospects. A career FDA official can expect $250,000–$500,000+ annual compensation in a pharmaceutical company role. This financial opportunity creates psychological pressure toward approval, especially for marginally significant drugs where approval decisions are discretionary. The industry exploits this: pharmaceutical companies explicitly hire FDA reviewers for their "access" and "relationships" with current FDA officials.


Class Analysis: Who Benefits, Who Pays

The Price Gap: United States vs. The World

U.S. manufacturer drug prices are 278% of prices in 33 OECD comparison countries—meaning the United States pays nearly three times what other wealthy nations pay for the same drugs. For brand-name originator drugs specifically, U.S. prices are 422% of prices in comparison countries. Even after adjusting for rebates and discounts, U.S. brand-name drug prices remain 308% of comparable nations’ prices. Prices in other developed countries average 36 cents on the dollar compared to U.S. brand-name drug prices. Canadian prices are 44% of U.S. prices.

This gap is not a natural market outcome. It is the direct result of policy choices—specifically the Medicare non-interference clause, patent thicket tolerance, and blocking of drug importation—that PhRMA has spent decades and hundreds of millions of dollars protecting and expanding.

Who Bears the Cost

Patients: Approximately 25% of Americans find it difficult to afford necessary prescriptions due to high costs. Nearly 30% say they have skipped or not taken medication as prescribed because of price. An estimated 1.1 million Medicare patients alone could die over the next decade because they cannot afford their prescribed medications. Per-person spending on prescription drugs sold in U.S. retail pharmacies increased from $520 in 1999 to $1,025 in 2017—nearly doubling in 18 years, significantly outpacing inflation. The median annual price for new drugs in 2023 was $300,000—a 35% increase from the prior year.

Taxpayers: Medicare, Medicaid, and other federal programs collectively fund 35% of all U.S. health consumption. Every policy that prevents Medicare from negotiating prices is a direct subsidy from taxpayers to pharmaceutical shareholders. The CBO estimated HR 3 would have saved Medicare $500 billion over 10 years—all of which, in the absence of HR 3, flows instead to drug companies.

Employers and workers: Rising drug costs drive up insurance premiums. Currently, 22 cents of every premium dollar spent on health insurance goes toward prescription drugs.

Who Benefits

PhRMA member companies: Combined annual domestic sales of PhRMA members reached $371.6 billion in 2024 (up 17% in a single year), with international revenues totaling $500.4 billion. Pharmaceutical company profit margins are consistently among the highest of any industry. The money spent on lobbying—roughly $30–40 million per year for PhRMA alone—is a small fraction of their revenues: the industry’s total $4.7 billion lobbying spend from 1999 to 2018 was only about 0.1% of the estimated $5.5 trillion spent on prescription drugs over the same period. The return on investment for political lobbying is extraordinary.

Industry executives and shareholders: Pharmaceutical CEO compensation routinely runs into the tens of millions annually. Company profits flow primarily to institutional investors, pension funds, and wealthy shareholders.

Washington insiders: The revolving door creates a class of professional intermediaries—former members of Congress, congressional staffers, FDA officials—who monetize their government service by helping pharmaceutical companies navigate and shape the regulatory environment. Billy Tauzin’s $11.6 million in 2010 represents the apex of this system, but hundreds of lesser-known figures follow the same path at smaller scale.

The Industry-Government Structural Lock

Seven-Step Structural Loop: PhRMA's most enduring achievement is not any single bill killed or passed but the structural arrangement it has helped create. (1) Congress sets drug policy through committees (Finance, HELP, Energy & Commerce, Ways & Means). (2) PhRMA funds those committee members through PAC contributions and dark money. (3) Staff circulate between congressional offices and PhRMA lobbying firms. (4) Regulatory officials move from the FDA to industry positions, carrying relationships and insider knowledge. (5) PhRMA defines the terms of debate through advertising, patient group funding, and think-tank support—making any price control appear as a threat to "innovation." (6) Patent law protects monopoly for decades beyond original exclusivity. (7) The VA and Medicaid negotiate drug prices successfully; Medicare was forbidden from doing so for 20 years; private insurance has limited leverage.

The pharmaceutical and health product industry lobby spent nearly 0.1% of its revenue on political influence and obtained pricing structures worth trillions. This is not corruption in the traditional sense—it is the legal structure of American health policy, systematically built over decades by the PhRMA network.

The Inflation Reduction Act represents the first breach in this structure. PhRMA’s record lobbying spend in 2024 and 2025, its active litigation to overturn the IRA’s negotiation program, and its dark money contributions to groups opposing the program suggest the industry views this breach as existential and is spending accordingly to close it.
