The Miers to Alito Switch

George W. Bush initially nominated Harriet Miers, his White House counsel, to replace Sandra Day O’Connor. Leo and the Federalist Society network mobilized against Miers, viewing her as insufficiently reliable on conservative legal priorities. The campaign was swift. Within 24 days Miers withdrew under pressure.

Alito was the replacement. Named four days after Miers’s withdrawal. Leo played an instrumental role in both the destruction of the Miers nomination and the selection of Alito. This was the same pipeline that had already delivered John Roberts to the Chief Justice seat. Between 2014 and 2017 Leo affiliated entities raised over $250 million from donors including Charles Koch and Rebekah Mercer to fund the broader judicial operation.

Analytical Pattern. Two Audience Problem

For the public the story was “conservative legal activists opposed a nominee they felt was unqualified.” For the donors the story was different. Leo’s network demonstrated it could veto a president’s Supreme Court pick and replace her with its preferred candidate in less than a month. The donors who funded the Federalist Society and Leo’s affiliated organizations were not paying for legal scholarship. They were paying for the power to select Supreme Court justices. The two audiences heard two different stories. The public heard “qualification concerns.” The donors understood “our money bought veto power over the most important judicial appointments in the country.”


Operation Higher Court

Rob Schenck, an evangelical activist turned whistleblower, ran “Operation Higher Court” for approximately 20 years. A campaign to recruit wealthy donors as “stealth missionaries” who gained social access to conservative justices through targeted philanthropy and personal relationships.

The method. Schenck encouraged wealthy supporters to befriend justices by making contributions to the Supreme Court Historical Society and other Court adjacent organizations. Once access was established through charitable giving, the donors cultivated personal relationships through private dinners, prayer circles, vacations at their residences, and hunting trips.

The key donors. Donald and Gayle Wright befriended Justices Alito and Clarence Thomas and the late Antonin Scalia. They treated the justices to dinners, vacations at their Jackson Hole, Wyoming residence, and at least one hunting trip.

The Hobby Lobby allegation. In June 2014 the Court decided Burwell v. Hobby Lobby Stores 5 to 4. Alito wrote the majority opinion. Schenck alleged that the Wrights dined with Alito and his wife before the ruling was released. And that Gayle Wright subsequently informed Schenck of the outcome before its official announcement.

The testimony. On December 8, 2022 Schenck testified under oath before the House Judiciary Committee affirming that he learned the Hobby Lobby outcome in advance from one of his “stealth missionaries” after she dined with the Alitos.

The denials. Alito called the allegations “completely false.” Gayle Wright denied that she or her husband learned the outcome from the Alitos. The Supreme Court’s internal investigation concluded Schenck was “not credible” but provided no detailed findings.

The enforcement. None. No mechanism exists to investigate or adjudicate the claim. The allegation remains unresolved.

Money

“Operation Higher Court” is the explicit version of what usually operates implicitly. A system where wealthy donors buy social proximity to justices through targeted philanthropy. The Supreme Court Historical Society. The Federalist Society’s annual dinner. Private retreats at donor properties. All serve as access venues. The question is not whether donors gain access. They demonstrably do. The question is whether that access influences outcomes. When Paul Singer flies a justice to Alaska and then wins a $2.4 billion case before that justice, the answer is structural, not speculative. When a donor allegedly learns a ruling outcome before release after dining with the author of the opinion, the system is not working as oversight intended. It is working as the donors intended.

Leo and Alito have traveled together multiple times beyond the Singer fishing trip, including visits to the Palace of Versailles. Leo functions as what The Nation described as a “matchmaker” connecting wealthy conservative donors with Supreme Court justices to maintain ideological alignment and social bonds.

The social network serves a strategic purpose. It keeps justices embedded in the donor class’s worldview. When Thomas attends Koch summits and Alito dines with Singer, they are not being bribed. They are being socialized. The capture operates through immersion, not transaction. Every vacation, every dinner, every private jet flight reinforces the same message. You belong to this world. Your friends are billionaires. Your social life is funded by the people whose cases you decide. The socialization is the mechanism.
